Antibody testing has not always been accepted as 2G or 3G detection during the pandemic. The Constitutional Court confirmed the action taken by the federal government. The Constitutional Court argued in its finding that there was too little scientific knowledge. Lerch now wants to lodge a complaint with the European Court of Human Rights in Strasbourg. According to a report by ORF Radio Vorarlberg, Lerch criticized “unequal treatment during the lockdown for the unvaccinated”. After a coronavirus infection, she had 3G proof as a recovered person for six months – but then no longer despite the antibodies detected. However, in its finding, which is also available to the APA, the VfGH stated: According to the “data available at the time of the regulation on infection, reinfection and duration of the immunological protection of those who have recovered”, it could be assumed “that natural immunity, according to the majority available antibody studies may decline within six to eight months of recovery and may be reduced to new virus variants due to immune escape mutations”.
Contrary to Lerch’s opinion, SARS-CoV-2 infections would not result in long-term immunity. Also because it is not known which neutralizing antibodies would provide effective immunological protection against a new SARS-CoV-2 infection, at what level and for how long, antibody detection is subject to considerable uncertainties, it said. Against the background of the omicron variant, the uncertainties associated with such antibody detection would be particularly significant.
