Incest case Amstetten: Josef F. remains in prison

The Higher Regional Court (OLG) Vienna had determined the need for further accommodation in an institution for mentally abnormal lawbreakers, the Krems Regional Court announced on Tuesday, which had previously decided otherwise.

The correctional court responsible for Stein Prison had released Josef F. conditionally from the execution of measures by order of April 1 and ordered that the life imprisonment imposed on him continue to be carried out. The public prosecutor’s office in Krems lodged a complaint, which was followed.

The decision was justified by the fact that there was still a serious, non-treatable illness that justified admission, the Krems Regional Court announced. In addition, according to the present appeal decision, “relevant and convincing indications for the assumption that the dangerousness has been sufficiently reduced” are missing. The conditions for admission to an institution for mentally abnormal offenders would therefore still be present.

Josef F. was sentenced to life imprisonment in March 2009 and also committed to an institution for mentally abnormal offenders. Since then he has been housed in the Krems-Stein prison. The prison court – in this case the Krems Regional Court – regularly checks whether the conditions for placement in prison are still met. This check is required by law, “at least once a year,” according to Krems.
