He had stabbed the 34-year-old three times in the stomach, which is why prosecutors had brought charges of attempted murder. The heavily intoxicated men had gotten into an argument before the knife attack, the reason for this: music that was too loud.
Originally, only one day was planned for the process in early June. However, at the end of the long day of trial, the questions to the jury had to be supplemented with regard to self-defense and a withdrawal from the attempted murder. On Friday, the accused received four years in prison for intentionally causing serious bodily harm.
“Difficult father-son relationship”
The two men clashed again on January 5, 2022, this time because of the loud music. The prosecutor spoke of a generally “difficult father-son relationship” and also said that the victim was “not a popular figure” and, according to the father, had “crossed borders several times”. The situation escalated as a result of the heavy consumption of alcohol, and the accused suddenly stabbed his son in the stomach three times with a “combat knife with full force”. He lost 1.5 liters of blood.
The public prosecutor actually had a clear intention to kill. Statements in court such as “I freaked out and stabbed” would prove this. According to the victim, he is said to have shouted “die son of a bitch, you’re going to die”. There is no evidence that the 66-year-old only wanted to defend himself because he had been physically attacked by the 34-year-old. And that the defendant, after seeing his son bleeding on the ground, called his wife, who is separated from him, could be interpreted differently, according to the prosecutor. Because even if he said in the phone call that the woman should call the rescue and the police, he also declared that he had killed the son.
Seriously injured on purpose
For the defense attorney, however, said call was an indication that he had withdrawn from the attempted murder. After all, his client set the rescue chain in motion. When the rescue appeared, he had already brought the seriously injured man into the stable side position and got a glass of water. Without help, the 34-year-old would have died, the expert had also explained.
The jury also found that the father “only” intentionally seriously injured the son. Both prosecutors and defense attorneys accepted the verdict.
