Josef Manner & Comp. Aktiengesellschaft: According to the verdict, the shaker bag of “Mozart Mignon Wafers” contains too little content and too much air, as the Association for Consumer Information (VKI) announced yesterday. The VKI had sued on behalf of the Ministry of Social Affairs. The Vienna Commercial Court confirmed the legal opinion of the VKI and judged the packaging of the shaker bag to be misleading. However, the judgment is not final. Manner announced in a statement that he would “of course” appeal against it.

In the proceedings before the HG, the products “Original Neapolitaner”, “Hazelnut Mignon” and “Mozart Mignon” in shaker bags were compared. The sachets for the three products are the same size and are presented close together on the shelves. However, there are differences in the filling quantity: While “Original Neapolitaner” and “Hazelnut Mignon” are filled with 400 grams, “Mozart Mignon” contains 100 grams less.

“The Mozart slices therefore have a filling level of less than 40 percent,” criticized VKI lawyer Verena Grubner. “Consumers should be able to trust that packaging is not oversized.” According to the Commercial Court, the notice of the net filling quantity on all sides of the packaging could not prevent misleading.
