Pepe acquitted of 23-day sentence for confrontation with Hugo Viana

The Court of Arbitration for Sport (TAD) has upheld the appeal filed by FC Porto regarding the 23-day suspension and a fine of 2870 euros imposed on Pepe after the classic game between the Dragons and Sporting on February 11 this year. Luis Gonçalves, who was suspended for 68 days and fined €1,910, saw TAD uphold the sanctions imposed by the Disciplinary Council (CD).

As regards the main case, in accordance with the decision to which write down had access, the court realized that the principle of the veracity of the referee’s report, the document that was the basis for the conviction of Pepe CD in the disciplinary process, was ultimately weakened by the testimony of the witness presented by Sporting themselves.

In the referee’s report, Pepe’s reason for exclusion was as follows: “Kicked the director of the opposing team, committing an act of violent behavior.” However, midfielder José Carlos Noronha, who was shown a photograph he claimed to have known by the defense, said that the wound caused by skin buildup on the sole was more consistent with the foot rather than the result of a kick, and in this case the typical upward movement of a kick would be indicative of a shifting of the skin from below upwards.”

The fact that the footage of the game was “impossible to verify the calcadela” and the FPF as the required holder of the CD was unable to prove its existence, the DVR realized that there was not enough evidence to keep the player sanctioned.
