Fuchs had to answer to the Ibiza investigative committee for breach of official secrecy and false testimony. The judgment was not final for the time being.
In December 2020, Fuchs is said to have passed on parts of the file to the now suspended section head Christian Pilnacek via a complaint against a “Presse” editor. The Economic and Corruption Prosecutor’s Office (WKStA) had prepared a complaint against the journalist based on an article she had written that was critical of the authority. Fuchs denied the transfer. The lawyer faced up to three years in prison.
In the Ibiza investigative committee in March 2021, he testified before the members of parliament that he could not remember having passed parts of the file to Pilnacek. Pilnacek exercised his right to refuse to testify on Wednesday in Innsbruck.
