Five children of former Angolan President José Eduardo dos Santos did not know that their father’s body had already been handed over to his widow and are considering filing a complaint with the European Court of Human Rights, a lawyer representing them said this Saturday.
The Angolan government announced this Saturday that the remains of former President of the Republic José Eduardo dos Santos, who died on July 8 in Barcelona, Spain, arrived in Luanda this afternoon.
The lawyer for one of the daughters, Chise dos Santos, who was litigating custody of the body in Spanish justice with Ana Paula dos Santos, ex-wife of José Eduardo dos Santos, told Luza this Saturday that she was unaware of the delivery of the body. authority of one of the parties that there are still appeals pending in court, although they do not have suspensive effect, and that there has been no court notice.
“Something happened. It is strange that one of the parties does not know about it, somehow qualify the situation,” said lawyer Carmen Varela.
The lawyer said that she was working “on the application” and spoke with Chise dos Santos, but that there would certainly be a complaint to the European Court of Human Rights from José Eduardo dos Santos’s five oldest children, who were thus deprived of the opportunity to at least “says goodbye” to his father in Barcelona.
On Thursday, Chise dos Santos already said he would file a complaint with the European Court of Human Rights if the Spanish court did not reverse the decision to transfer the body to his ex-wife.

On one side were Chise dos Santos and his older brothers, who were against the transfer of the remains of the former first lady and were opposed to holding a state funeral ahead of the 24 August elections to avoid political exploitation.
On the other was the widow Ana Paula dos Santos and her three children together with José Eduardo dos Santos, who also claimed the body and wanted it to be buried in Angola.
On Wednesday, the court decided to attribute the body to the ex-wife and authorized the transfer to Angola after it finally concluded that José Eduardo dos Santos died of natural causes.
The five older children filed an appeal against the decision on Thursday, which was rejected but brought forward a new “appeal” and a request for a funeral in Barcelona, lawyer Carmen Varela told Lusa this Saturday.
This type of appeal has no suspensive effect, explained the lawyer representing Chise dos Santos, who added that, however, the court did not give notice of the decision or of the transfer of José Eduardo dos Santos’ body to his widow.
According to the lawyer, in addition to the appeal, a petition was submitted to the court for burial in Barcelona, and not in Angola, referring to the fact that in this case “five children could not leave” because “their lives were in danger there.”
“The damage to the five children would have been irreversible because they couldn’t go to their father’s funeral in Angola. Therefore, we ask, if it were not suspensive, at least that the funeral be in Barcelona, ”explained the lawyer.
On Friday, the judge asked “the other side” whether he would agree to a funeral in Barcelona, according to a spokesman for Chise dos Santos, with no further information from the court yet.
