According to the public prosecutor’s office, the man, who had already been sentenced to one year of partially conditional imprisonment this year for various offenses in connection with his anti-measures activism, admitted the facts but denied re-activation.
The Upper Austrian was repeatedly involved in serious conflicts with the police and authorities for a long time. In March he was already in court in Linz. The trial involved, among other things, false allegations against a police officer and the publication of official data. The then 38-year-old received a one-year prison sentence, eight months of which was conditional, for defamation, false testimony, slander, insult and falsification of evidence. In case of doubt, he was acquitted of the allegations of dangerous threats and the provision of abuse of office.
According to the Linz public prosecutor’s office, the verdict is now final. In the current trial, this will have to be considered, ie in the event of a guilty verdict, an additional penalty will be imposed. The penalty for the accused Paragraph 3h Prohibition Act is between one and ten years.
