The spill occurred on January 15 while the tanker “sea Doricum“, under the Italian flag, unloaded crude oil in the La Pampilla refineryin Window30 km north of Lima and owned by Repsol.

The oil company attributed the incident to waves caused by the volcanic eruption in the island of Tongaon the other side of the Pacific Ocean, and the government of Peru described it as “disaster ecological“.

The oil spill affected more than 700,000 inhabitantsmostly fishermen, and forced the closure of more than twenty beaches and dozens of shops in the tourist areas.

Details of the lawsuit against Repsol

This lawsuit was filed in May by Indecopi against six jointly and severally liable companies: Repsol (Spain), Mapfre Global risks (Spain), Mapfre Peru Insurance and Reinsurance Companies (Peru), Refinery The pampilla (Peru), transtotal Agency Maritime (Peru) and Fratelli d´amico Armatori (Italy, owner of the tanker involved).

Indecopi claims 3,000 million dollars for damage environmental and 1,500 million for damage moral affected consumers, users and third parties.

Repsol did not immediately react to the court’s decision, but after the lawsuit was filed in May, it said the complaint was baseless.

Indecopi’s claim is unfoundedinappropriate and incongruous,” the oil company said on its website at the time. “Their estimates lack the slightest basis to support the figures indicated,” he stressed.

The oil slick spread through waters and coasts up to 140 kilometers north of the refinery, causing the death of an undetermined number of fish, birds and marine mammals.

The ship involved remains anchored in front of the port of Callao, prohibited from leaving Peru.
