UNITA, the Angolan opposition, filed an electoral dispute this Thursday with the Constitutional Court (CC), demanding the annulment of the August 24 general election in which the MPLA was declared the winner, citing “several irregularities” in the process.
A source close to the leadership of the National Union for the Total Independence of Angola (UNITA) told Lusa that in the request for the cancellation of the elections sent to the TC, “several complaints were listed that amounted to illegal actions” recorded throughout the electoral process.
“Then we complained about the whole procedure that the National Electoral Commission [CNE] throughout the entire electoral process, violations, namely the issue of non-compliance with the Organic Law on General Elections,” the source explained.
The fact that the president of the CNE “approved several rules after the announcement of the general election, which, by law, could no longer pass any electoral legislation” is also included in the issues listed in the petition.
“[O presidente da CNE] adopted a number of resolutions, which in some ways even contradicted the law on general elections,” he stressed.
On the other hand, he added: “The issues related to the tabulation, the inability of our representative to file a complaint with the CNE itself, all this was listed and even required to cancel the elections.”
According to the Organic Law on General Elections, an application for filing a contentious complaint with the IC must contain relevant statements containing the relevant grounds and conclusions, be accompanied by all documents and contain an indication of other evidence.
The law stipulates that the TC must order notification of interested parties so that they, if they wish, can make a statement against the charges within 72 hours, and the plenary session of the judiciary makes a final decision within 72 hours, counting from the end of the time limit for filing counterclaims.
On Monday, CNE President Manuel Pereira da Silva released the final protocols of the August 24 general elections, in which the Popular Movement for the Liberation of Angola (MPLA) and its candidate João Lourenço were declared the winners with 51.17% of the vote. , followed by UNITA with 43.95%.
With these results, the MPLA elected 124 deputies and UNITA elected 90 deputies, almost twice as many as in the 2017 elections.
The Party of Social Renewal (PRS) won two seats in parliament, gaining 1.14% of the vote, the same number of deputies received the National Liberation Front of Angola (FNLA) and the Humanist Party of Angola (PHA) with 1.06%. and 1.02% of the vote, respectively.
The CASA-CE coalition, APN and P-Njango did not win seats in the National Assembly, which will consist of 220 deputies in 2022-2017.
