Process in Steyr: Was a Ukrainian girl raped?

The Syrian denies the rape, he speaks of consensual sex. The case had made waves in Upper Austria because no pre-trial detention had been imposed on the suspect.

The public prosecutor had stated that initially there was insufficient suspicion to apply for pre-trial detention. However, the state of Upper Austria transferred the young man from Weyer to another refugee camp.

Both the Syrian and the Ukrainian girl with their family stayed in the accommodation in Weyer in May. According to the prosecutor, friends of the two met first on the afternoon of May 11, later they also joined. Alcohol was drunk, then the accused and the 15-year-old disappeared for a good 30 minutes. At that time, the Syrian is likely to have passed on the girl near the train tracks, about 250 meters from the playground.

Not entrusted to the mother out of shame

The fact that the young people didn’t show anything after returning to the group was out of “shame”, as the prosecutor said. This was also the reason why the daughter did not confide in her mother. It was only when the brother noticed a band-aid on his sister’s neck the following day that she told what had happened. They went to the police, filed a complaint and the girl was examined at the hospital. In addition to the strangulation marks on her neck, she also had bruises on her chest and buttocks.

The Syrian’s defender described the injuries as “hickeys”. One cannot say “with a probability bordering on certainty” that there was a rape. His client’s version that everything took place amicably therefore sounds “plausible” to him. The two must have had contact via social media before that evening, and there is also a photo of the two kissing.

The prosecutor explained that the girl involved herself in contradictions in her testimony with the alcohol consumption. Therefore, the 15-year-old could not describe the exact course of events.

When the Syrian took his place in the dock, the public was temporarily excluded. It was initially still open whether she would be admitted again in the statements of the medical expert. According to the report, the injuries to the neck “can be assigned to a choking process”. A verdict is scheduled for Wednesday.
