The Viennese was accused of hitting his 49-year-old partner with a car in Eibesbrunn in the municipality of Großebersdorf (Mistelbach district) the previous year and killing him as a result. The guilty verdict is final according to the court. The cause was initially investigated on suspicion of murder.
The accused, defended by Farid Rifaat, was specifically accused in the criminal complaint of having neglected the care required for road traffic due to a lack of attention and alcohol consumption. The 49-year-old who appeared on the road is said to have been rammed by the man with his car – a powerful Dodge Ram. The degree of alcoholization of the accused was given as “at least 1.89 per mille”.
The incident happened on the night of November 22, 2021. The 49-year-old was found motionless in the area of the entrance to a gas station in the Eibesbrunn area. A witness set the rescue chain in motion. The injured woman was resuscitated and flown to a hospital in Vienna by emergency helicopter, where she later died. The autopsy showed that the Lower Austrian suffered a blunt chest trauma with serial rib fractures and lung injuries. The immediate cause of death was circulatory failure associated with bleeding into the left chest cavity.
The 55-year-old, who had initially moved away from the scene, was arrested. The public prosecutor’s office applied for the imposition of pre-trial detention on the accused. However, a detention and legal protection judge saw no urgent suspicion of murder, but rather grossly negligent homicide under the influence of alcohol. The Austrian citizen was released on bail of 25,000 euros.
The cause was then illuminated, among other things, by calling in a motor vehicle technical expert. The investigation finally came to the conclusion that the 49-year-old had initially been in the car with her partner, but then got out in the unlit parking lot of the gas station to relieve herself. The drunk 55-year-old is said to have driven his car in circles in the parking lot and caught the squatting woman with the car.
According to the court, the accused confessed during the main hearing. The penalty was up to three years.
