The Department of Justice, in its presentation made in the last hours of Friday, argued that Judge Aileen Cannon “erred in granting precautionary measures”, but limited her appeal only to “the almost 100 records that bear classified marks”, recovered from Trump’s property.
Delaying the review of classified documents owned by the government according to the appeal “impedes efforts to protect national security,” the appeal quoted by the AFP news agency as saying.
“This further irreparably hurts the government by ordering extreme steps in an ongoing criminal investigation and forcing the unnecessary disclosure of highly sensitive records, including plaintiff counsel,” the filing added, referring to Trump’s proxies.
As the former Republican president faces mounting legal pressure, the Justice Department maintains the top-secret documents seized were “likely hidden” to obstruct an FBI investigation into the former president’s possible mishandling of classified materials.
Trump denied any wrongdoing, saying the raid on his mansion was “one of the most outrageous assaults on democracy in the history” of the country, in addition to constantly mentioning it at his political rallies.
The appeal will first be studied by a panel of three judges, but could eventually escalate to the Supreme Court, with a conservative majority behind the justices appointed by Trump himself.
Last Thursday, Judge Cannon appointed Raymond Dearie to review the files under the figure known as “special master.”
Dearie issued an order yesterday to Trump’s legal team and the Justice Department’s attorney calling a meeting Tuesday next week in New York.
In addition to the documents case, Trump faces investigations into his business practices, his efforts to overturn the results of the 2020 election, and the Jan. 6, 2021, attack on Capitol Hill by his supporters.
