As it turned out, several pieces of evidence such as video recordings and mobile phone content are no longer tangible.
The 13-year-old is said to have met the accused through an acquaintance and asked her to pick her up from a crisis care facility in Kapfenberg in Upper Styria in January 2021 and bring her to Graz. Since his car broke down, he asked an acquaintance to take him and the girl to the train station. This acquaintance was also charged because he – like the first accused – is said to possess child pornographic material.
On the train, the 44-year-old is said to have touched the girl immorally and put his head in her lap. The man vehemently denied these allegations. His lawyer requested the video recordings from the S-Bahn as evidence of his client’s innocence, and he also wanted to hear the train attendant as a witness. She is said to have sat two rows behind the two.
Video recordings no longer available
However, as it turned out, the video recordings are only kept for five days, so they should have been requested immediately after the incident. The girl’s cell phone was secured, but the mother had previously deleted some. A policewoman had photographed important messages, but these also disappeared after an official mobile phone exchange. Finally, the train attendant was only traveling privately, since there was no such thing on the S-Bahn, they said.
An employee from the care facility stated that the 13-year-old ran away and that she was looking for her in a parking lot. There she also wants to have asked the two accused, who were sitting in a black car, about the girl. However, the two agreed that they had never spoken to the woman.
The mother had to admit that her daughter had run away several times. In the accused case, she apparently wanted to meet a “Raffi” in Graz and needed someone to help her get away from Kapfenberg. When the mother finally found her daughter near the house, she was “very upset”.
There were already signs of an adjournment in the morning, but other witnesses were initially heard.
