He claimed that during an argument he opened the knife but did not stab it. He couldn’t explain the injuries. The 21-year-old brother made use of his right of refusal and did not testify as a witness. His statements were therefore not usable in the investigation. The public prosecutor’s office originally investigated the case for attempted murder. The 19-year-old returned to Vienna last spring after spending several months abroad and turned up at his brother’s house in the first week of April, where he wanted to spend the night. “I had no choice but to sleep with him,” the accused told the jury.
However, his brother did not allow him to sleep. Because of the 19-year-old’s erratic lifestyle, drug addiction and personality structure, he didn’t want him in the apartment. The younger brother freaked out because of that. He first smashed a TV, a mirror and a microwave oven, then smashed a plasterboard wall with his fist and finally wanted to stab his brother in the upper body with the knife.
“But he is a professional soldier and has experience in hand-to-hand combat,” the prosecutor knew. Therefore, the 21-year-old managed to deflect the attack – the blade went to the lumbar region, a second stab hit the elbow, then the soldier wrested the weapon from his brother. The incident was incriminated as intentionally attempted serious bodily harm.
“I think I have anger issues,” admitted the defendant. Because in addition to the knife attack, the public prosecutor charged him with dangerous threats and physical harm in public spaces. At the Praterstern he had given a girl a slap in the face and her two companions kicked for a trivial reason. A security employee from Wiener Linien received a punch because he caught the 19-year-old without a ticket, two ÖBB train attendants experienced the same thing when they caught the boy farting on the Salzburg-Vienna route. A tourist from China was headbutted for not wanting to give the 19-year-old a cigarette.
