Students threatened to run amok: convicted without punishment

They confessed to their act and stated that they had come up with this idea because of massive bullying. The judge found both guilty but only issued instructions.

According to their own statements, the two boys were tortured and attacked by the others in their school. “It all sounds terrible, but why didn’t you go to a teacher?” asked judge Andrea Schwinger-Wagner. The two didn’t do that, but soon the rumor about a planned killing spree made the rounds. “At first it was just fun, then we said we’re going to do it,” said the 16-year-old.

The plans were becoming more and more concrete, at least to the outside world, so the duo was already talking about clothing and weapons. The elder is said to have written to a friend “I will kill everyone, blow up the school and then kill myself”. There is also said to have been a list of those who wished to be spared because they were not among the bullies. “We wanted to be taken seriously, but we didn’t really want to do it,” emphasized the accused.

The 15-year-old was in adolescent psychiatry at the time the killing spree was supposed to take place. He has always found the subject of killing sprees interesting “even more so when I was humiliated because of my sexuality,” he said. He repeatedly empathized with the perpetrator “so as not to feel so powerless”. The bullies at school repeatedly threatened him and his friend with violence. Part of the hearing took place behind closed doors.

In her closing speech, the prosecutor emphasized that it was a dangerous threat, even if “the massive bullying may have been terrible.” It is questionable, however, in which details the killing spree was discussed. “It was not harmless idle talk,” the prosecutor was convinced. “I’m really sorry for every person who was really scared,” said the 15-year-old in his closing remarks. “The whole thing is very shocking and bordering on execution,” said the judge. She found the two guilty, but imposed no punishment – over a probationary period of three years. Instead, there were instructions to undergo psychotherapy and bullying counseling. In addition, probation should be provided. The judgment is not final.
