Defendant in the Leonie case: “I was ashamed”

Three young men are said to have drugged 13-year-old Leonie in an apartment in Vienna on June 26, 2021 and then sexually assaulted her. The girl did not survive the drug cocktail. The autopsy report revealed that the 13-year-old died violently as a result of drug poisoning and suffocation. The central question in the trial is who administered the ecstasy. So far, the men have blamed each other. They denied the allegation of rape.

On the fifth day of the trial, the second defendant changed his testimony. The now 19-year-old has now admitted to having had sexual intercourse with the 13-year-old. The accused, who lived in the crime apartment, always claimed to have only cuddled with the girl. However, DNA evidence disproved this version. “I should have said that before but I was scared,” he said. It was consensual sex. “I apologize for not saying so before.” With all other statements he would have told the truth so far. When asked by an assessor why he was afraid, he said accused: “I have … myself ashamed.” Also the repeated question as to why: “I don’t know.”

On the fifth day of the trial, more witnesses spoke. These are friends and acquaintances of the accused who had contact with the accused shortly after the 13-year-old’s death. “He called me and said he needed my help,” said the friend of the second accused. They met the 19-year-old at Kagran with another friend. The three were in the car when the 19-year-old began to say that the first and third defendants had shown up at his apartment with a girl. The 13-year-old voluntarily took an ecstasy tablet, and the other two secretly dissolved eight to nine in a drink that the girl gradually unknowingly consumed.

“They didn’t want to call for rescue”

When the drugs began to take effect, the two men carried out sexual acts against the will of the Lower Austrian. “She didn’t want that,” said the 20-year-old about his friend’s stories on the witness stand. The girl was getting worse and worse, so they gave him Ayran and showered his head. His friend still wanted to get the rescue, but the others “didn’t want that”. The first accused would then have carried the 13-year-old out and placed it under the tree, where she was found by passers-by. Any help came too late. “Go to the police or I’ll do it,” said the 20-year-old at the time to the accused. “I could tell he was in shock.” Because the 19-year-old didn’t dare, he went with the acquaintance to an inspection and filed a complaint.

The witness claims to have noticed that not only the three suspects and the 13-year-old were in the apartment on the night of the crime, but another man and a girl. “I passed this on to Homicide, but they didn’t take it seriously,” the witness said. Most of the lawyers then requested that the two be summoned as witnesses. Presiding judge Anna Marchart has not yet decided on this.

Verdicts scheduled for December 2nd

The first accused also confided in an acquaintance. He showered and slept with his friend before he went abroad. The 25-year-old overheard the accused making video calls to the third-party accused. There, the two blamed each other for giving the girl too much of the drugs. “When I heard the whole thing, I was shocked. That they would do something like that to such a young girl.” He then informed the police and cooperated with the authorities. “If they really did something like that, they should be held accountable,” said the 25-year-old. However, his friend was then no longer available by phone.

The men of Afghan descent are between 19 and 24 years old. For the eldest, whose birthday is on the fifth day of the trial and who was an adult at the time of the offence, a guilty verdict would mean 10 to 20 years or life. The other two would face up to 20 years if convicted in accordance with the indictment.

With the day of the hearing on Monday, which ended in the early afternoon, two more appointments are planned. According to the current situation, the verdicts should fall on December 2nd.
