Rape: Defeat before OGH for ex-mayor

The Supreme Court (OGH) has rejected its nullity appeal. Now the Linz Higher Regional Court still has to deal with the appeals of the accused and the public prosecutor.

The former ÖVP politician is said to have sexually harassed an employee twice between 2014 and 2016, raped her three times and – when she finally broke her silence – slandered her. After the employee had made allegations against him, he had reported him for defamation and brought an action for an injunction. The resulting investigations eventually brought him to court himself. The prosecution was based, among other things, on a handkerchief with DNA traces of both presented by the alleged victim. The accused vehemently denied all allegations in the process and located an intrigue.

The man resigned his seat in the state parliament in the course of the proceedings, but he initially remained in office as mayor and was even re-elected a few days before his verdict. He then resigned as mayor.
