The Peruvian Constitutional Court declared the treason complaint against the President null and void

The TC “has resolved declare the petition for habeas corpus founded and declare the nullity of the agreement of the Subcommittee on Constitutional Accusations of the Congress of the Republic dated February 28, 2022″, points to the document.

The judges considered that the accusation violated “the right to due motivation in parliament.”

The Subcommittee on Constitutional Accusations, in a divided decision -11 votes to 10-, charged Castillo with the alleged crime of treason for having expressed in an interview that he would be willing to grant Bolivia an outlet to the sea if it were the decision of the citizens.

In addition, they recommended that Castillo could not hold public office for five years.

The resource of habeas corpus was filed last Tuesday by one of the president’s lawyersEduardo Pachas, who explained that “The crime of treason against the homeland has a sentence of 15 years in prison, for this reason his personal freedom is in danger.”

The accusation had already been questioned by the TC judges that same day, during a hearing intended for the subcommittee to support it, when magistrate Gustavo Gutiérrez Ticse asked the parliamentary attorney if “opinion is a crime”according to the Peruvian newspaper La República.
