Prosecutors accused the 31-year-old mother of falling asleep in the bedroom with the window open in May this year, even though her two-year-old daughter was in the room. The child must have climbed over the bedside table onto the window sill and then fell down.

However, in the single judge proceedings it was not possible to determine whether the window was open or whether the girl had opened the window. The mother was pregnant and also sick and tired when she nodded off in bed. In any case, no gross negligence was recognizable, only “simple” negligence. The judge ruled that slight negligence in the family association is a legal reason for an exemption from criminal prosecution and handed down an acquittal.

The child suffered a fractured skull base and other broken bones in the fall. It’s well again now.
