Prosecutors had charged two women with neglecting defenseless people. Already on Tuesday, a 62-year-old co-accused was acquitted of the charge of serious coercion in case of doubt. According to the regional court, all three judgments are not final.
The two women were in court because they are said to have done nothing against an infestation of itch mites in the home in 2021. The 49-year-old first accused was also accused of negligent bodily harm and – due to alleged entries in the electronic care documentation in someone else’s name – data falsification. According to the information provided by the two women, there was no suspicion of scabies in the home during the period specified by the public prosecutor.
Employee threatened with lawsuit?
The 62-year-old was accused of having threatened an employee with a lawsuit for 200,000 euros if she did not sign the amicable termination of the employment relationship. He had “never in his life forced the employees to sign,” said the accused.
The trio had pleaded not guilty at the start of the trial earlier this week. On Monday, in addition to the accused, witnesses also had their say. On Tuesday, in addition to questions for the expert, further witness interviews were on the agenda. The 56-year-old second accused and the 62-year-old are still employed by the home operator Senecura.
Happy about acquittals
A spokesman for the Senecura group said they were happy about the acquittals. As it turned out, many allegations were based on hearsay and “could be completely invalidated by numerous witness statements”. The Covid situation posed major challenges for both the team in Kirchberg am Wechsel and the entire care industry in Austria. The employees “have tried everything to maintain our high standards even in this difficult time of the corona pandemic,” said the spokesman.
