The highest German court should examine the decision of the Higher Regional Court (OLG) Stuttgart to continue the detention for more than half a year, according to a statement distributed in Stuttgart on Saturday. “The constitutional complaint is necessary in order to appeal to the European Court of Human Rights in a next step.” The lawyers complain that judges have repeatedly canceled detention hearings without Ballweg being able to fully present his point of view. “In the eyes of the defense, this constitutes a violation of the right to be heard and requires sharp criticism.” Just a few days ago, the district court in Stuttgart again rejected the release of the 48-year-old from prison.
The Higher Regional Court decided at the beginning of the year that Ballweg must remain in custody for a period of six months. According to the current facts and evidence, the accused is still strongly suspected of attempted commercial fraud and money laundering if there is a risk of absconding. Since the arrest on June 29, the public prosecutor’s office has “consistently conducted the investigation quickly and with the necessary acceleration”.
The “lateral thinking” movement had formed in many German cities from Stuttgart in the course of the corona pandemic. The supporters repeatedly demonstrated publicly against the political measures to contain the virus. There were also attacks on police officers and media representatives. The Office for the Protection of the Constitution monitors the scene for anti-constitutional views, conspiracy ideologies and anti-Semitic tendencies.
