After a single judge had passed a judgment of incompetence last year because of the seriousness of the baby’s injuries, the jury trial against the parents begins on Tuesday in the Linz Regional Court. Mother and father now have to answer for the suspicion of deliberately causing serious bodily harm. They are said to have broken the newborn’s bones several times. So far they have denied this.
Ten days after the birth on May 20, 2020, according to the indictment, the martyrdom of the son of an Austrian woman and her husband from Bangladesh is said to have begun. From April 13th to May 16th, the premature baby suffered a fracture of the right thigh, fractures of the growth plates on the upper arms, serial fractures of ribs and a skull fracture. In the first trial, the coroner cited “massive violence” as the only explanation for the serious injuries. Therefore, the single judge did not consider the criminal offense “tormenting an underage, younger or defenseless person” to be sufficient. The current indictment was supplemented by deliberately causing serious bodily harm and thus became a case for a lay judge. If found guilty, the parents face between one and ten years in prison. It was still uncertain whether there would be a verdict on Tuesday.
