State Administrative Court decided: No EIA obligation for the “Quadrill” project

The construction work for the major Kufsteiner Bodner Bau project is already in full swing. In the next few weeks, construction of the tower levels for the 109 meter tower, among other things, will begin. A four-part building ensemble with residential, office, retail and restaurant space will be built by 2025.

Several neighbors had lodged complaints against the high-rise project, believing that construction would require an EIA process. Based on the procedural documents and the oral hearing, the state administrative court came to the conclusion that the complaints were to be dismissed, according to the statement.

The judges followed the assessment of the Upper Austria. State government as well as the Linz magistrate, according to which there is no EIA obligation. “An EIA obligation for the construction project in question was not recognizable. The requested project size did not reach the legal EIA threshold values,” says the judgment published today, in which the complaints are dismissed as unfounded.

Citizens’ initiative disappointed

The citizens’ initiative “Tobacco factory – we talk to” reacted “shocked” about the procedure. According to spokeswoman Brita Piovesan, gross mistakes and “tricks” on the part of the contractor could be proven, but these would be wiped off the table with the verdict. The citizens’ initiative sees the last chance to have the “tailor-made development plan” examined by the Constitutional Court. The further course of action will now be discussed with residents and lawyers, Piovesan continued.
