The co-accused father was acquitted – also not legally binding. The parents had vehemently denied intentionally hurting the baby.
Ten days after the birth on March 20, 2020, according to the indictment, the martyrdom of the son of an Austrian woman and her husband from Bangladesh is said to have begun. From April 13th to May 16th, the premature baby suffered a fracture of the right thigh, fractures of the growth plates on the upper arms, serial fractures of ribs and a skull fracture. The coroner cited “direct, massive violence” as the only explanation for the serious injuries in the report.
The 27-year-old defendant and the 25-year-old defendant before the lay judges firmly denied intentionally causing serious bodily harm. This did not then see it as proven that the mother in particular had deliberately abused the child. Therefore, she was convicted of torturing an underage, defenseless person. For the father there was an acquittal in case of doubt. The verdicts are not final, the mother took time to think about it, as did the public prosecutor in both cases.

Parents cannot explain their baby’s serious injuries
During the trial, the parents were unable to answer the question of how the infant got injured. “Nothing happened,” the woman assured. She neither grabbed nor shook her son. Her husband also “did everything great”. The defendant asserted that she “always took good care of the child”. A social worker who was notified by the hospital after the premature birth noticed during a visit to the young family that the mother made little eye contact with the baby, she described her impression to the court. However, she did not find any evidence of abuse. The parents would have shown her a swelling on the baby’s ear and expressly assured her that they had not pinched the son.
A mobile pediatric nurse, who came regularly for a long time, found that she was overwhelmed with everyday things. However, the mother was “trying” to build an emotional bond with the child. But she didn’t notice anything about the martyrdom of the little one.
“Textbook Injuries”
Ultimately, a doctor from a Linz hospital reported the suspicion of abuse to the police after the father had come to the outpatient clinic on May 16, 2020 with a broken thigh. The baby was then diagnosed with other fractures in various stages of healing. The doctor spoke of injuries like in the “textbook of child abuse”. Her father was shocked and surprised, she recalled.
To her knowledge, the baby obviously did not suffer any permanent damage from the significant injuries, the pediatrician stated in court the result of the last examination in September 2021. The boy lives in a foster family.
