Why a new constituent process?
This new process began to take shape after in September 61% of Chileans decided not to approve the constitutional text who had written the Constituent Convention, created after the social outbreak of October 2019 which, among other things, called for the drafting of a new Constitution.
Unlike the process rejected in the plebiscite on September 4, the new one will have a limited participation of indigenous peoplessince their candidates they can be part of the Constitutional Council only if they achieve a vote equivalent to 1.5% of the vote of the national register.
The steps to follow from now on
the first task of this second constitutional process rests with Congressthat must designate 24 members of the Expert Commissionwho will begin his functions on March 6 and whose task will be to write a draft with the 12 constitutional bases established in the “Agreement for Chile” signed last December 12 by the political parties with parliamentary representation.
Both the ruling party and the opposition will elect half of the members of this commission, respecting gender parity, and both chambers must approve the lists of experts by four sevenths of the votes. To be a member of the Expert Commission it is necessary have the right to vote, college degree or academic degree, in addition to accredit work experience of not less than ten years in the public or private sector.
Subsequently, on May 7, in an election with compulsory voting, the 50 members of Constitutional Council more seats for indigenous peoples advisors according to the percentage of vote. This council, which will begin its functions on June 7, must to debate the Draft of the Expert Commission.
In parallel, it will work a Admissibility Technical Committeewith 14 members appointed by Congresswho will watch over him compliance with the “Agreement for Chile” with its 12 institutional bases, ranging from the fact that Chile is a Republic to the fact that the autonomy of the Central Bank must be respected.
