Bloody deed to wife in Linz: 15 years for attempted murder

The prosecutor had asked for the maximum penalty. The judgment is final. The defendant had defended himself by saying that, as a man of Oriental origin, he had found it difficult to cope with being humiliated by his wife.

The Syrian is said to have stabbed his wife several times in the neck with a carpet knife during an argument. The 41-year-old only survived thanks to a string of fortunate circumstances and some courageous people who stepped in and incapacitated the attacker at considerable risk of their own: a cleric tried to get him to surrender and was forced to retreat with a knife by the defendant himself, a woman jumped in the back of the ruthless 52-year-old – “We couldn’t let him stab her,” she said in court. The crew of an ambulance that happened to be passing by, as well as medically knowledgeable passers-by, quickly provided first aid.

jealousy as a motive

The prosecutor said the motive for the crime was jealousy because the woman had been in contact with other men via social media. The defender said that as far as the motive is concerned, one has to look at the cultural background. The defendant denies the intent to kill. He described himself as “very liberal”, but at the same time said that his wife was not allowed to have contact with strangers and had committed “high treason”.

Murder process for almost stabbed wife: prosecutor demands maximum penalty

According to Adelheid Kastner’s psychiatric report, the accused is sane and guilty. There is no medical explanation for the memory gaps he claims, other than that he doesn’t want to remember. According to the expert, he respected the Austrian laws “to the outside world, but not within the family.” It can be assumed that he will continue this pattern in future relationships.

Prosecutor: “Intention to kill”

There is “a difference between our circumstances and the conditions in Austria,” countered the accused. In the Arab world it is forbidden for a married woman to have contact with another man. And he couldn’t shake off “the culture that I’ve experienced in Austria in six years”. After a lengthy dispute with the judge on women’s rights, he sheepishly admitted that one shouldn’t mistreat one’s wife in Syria either, but had to get a divorce if the relationship no longer worked.

For the public prosecutor it was clear that the accused had an intention to kill “and even an intention to kill”. This is shown by the pattern of injuries alone – the Syrian’s wife had suffered, among other things, very deep stab and cut injuries on her neck. The prosecutor had asked for the maximum sentence. The defender, on the other hand, had “most likely seen an attempted manslaughter” or even an intentionally serious bodily harm.

The jury returned a 7 to 1 attempted murder. In addition, the man was found guilty (unanimously) of coercion because he pushed the pastor back with the knife. He was sentenced to 15 years with a sentence of ten to 20 years or life imprisonment. Cleanliness and the fact that it was just an attempt were rated as mitigating. “We couldn’t see a remorseful confession,” said the chairwoman in the verdict. The use of a weapon, the fact that the act was directed against a relative and that a felony and a misdemeanor occurred together were rated as aggravating. The man has to pay his wife 10,000 euros in damages. Defense and prosecution waived appeals.
