The case, in which the musician and security agent died evaldo From Santos Rosa and a passerby can picker who tried to help him, Luciano Macedo, caused a great impact at the time, when the city was under a military operation.
Santos Rosa, 51, was circulating with his family in the Guadalupe neighborhood, in the north of Rio, on the security perimeter of a military area. It was Sunday afternoon and they were heading to a baby shower party.
His vehicle was riddled with 82 shots, according to the indictment. The musician died on the spot. His father-in-law was injured, and his wife, their 7-year-old son and a 13-year-old girl were unharmed.
Macedo was shot while trying to help the musician and died days later.
“There is no defense for 82 shots. They all joined the same will. 82 shots is execution“, declared the military prosecutor Luciano Gorilhas during the trial.
An initial investigation pointed out that the soldiers may have mistaken the family car – where no weapon was found – with a vehicle of alleged assailants.
The trial, in which four other defendants were acquitted, began on Wednesday and lasted for about 15 hours, until early Thursday morning.
The defense announced that it will appeal the sentences, according to it declared to the local press. Convicted military men will remain free until all resources are exhausted.
In statements released by the G1 news site, the widow of the late musician, Luciana, said the sentence “brought peace to his soul.”
“I know you are not going to give me my husband back, but it would not be fair to leave here without a positive response,” she said.
In recent years, many Brazilian military personnel have participated in operations against crime in Rio. From February to December 2018, they were at the forefront of the security of this state overwhelmed by violence.
A law passed in Brazil in 2017 determined that civilian deaths that occurred in the context of military activities must be judged by the Military Justice.
