The accused did not confess. “Absolutely not guilty,” said the alleged 22-year-old, who looks much older on the outside. His compatriot, who is also from Syria, said: “I am both guilty and not guilty.” Due to his language deficits – he had come to Austria in 2021 – he did not notice that the young woman had mental disabilities and did not agree that he approached her. “He speaks very bad German. He couldn’t tell what she wanted from her communication behavior,” the boy’s legal assistant noted.

In addition, it is questionable whether sexual acts took place in the cabin at all, the lawyer pointed out. Because two employees working on the station premises noticed how the 18-year-old they knew was being led by several men in the direction of the toilet facility. They went after the group. When there was no response to their knock on the locked cabin door, they unlocked it. The 18-year-old was scantily clad at the time and was shaking and crying.
He was guilty insofar as “I didn’t tell her to go out,” the 17-year-old said in his court hearing. He did not take the young woman with him with intent to abuse. She just came along, he claimed.
Boys (12) were lookouts
According to the indictment, the older defendant is said to have been involved in the act insofar as he went to the cabin with the 17-year-old and the woman with intent to abuse, shook the door after a short time and “Come out, I want to too!” shouted, as the prosecutor noted. The young woman “clearly signaled from the beginning that she does not want any sexual contact,” emphasized the prosecutor.
Two boys who were only twelve years old and were therefore not responsible for punishment were also involved in the whole thing. According to the indictment, they are said to have been a lookout and took the handbag from the 18-year-old after the young woman had been taken out of the toilet stall. Since the two children are not yet 14, they cannot be prosecuted. They were only invited to the hearing as witnesses.
