The 24-year-old’s nullity appeal was dismissed, as were both penal appeals. This means that all judgments in the case, which was extensively reported in the media, are final.
The body of the girl from Lower Austria was found lifeless on June 26, 2021 on a green strip in Vienna-Donaustadt by passers-by. According to the findings of the Vienna Regional Court, the 13-year-old died as a result of drug poisoning – she had been given seven ecstasy tablets containing MDMA. The 24-year-old was found guilty in the first instance as the direct perpetrator of murder and rape with the maximum penalty, and the 20-year-old was found guilty of murder by omission.
At the beginning of the court day, Advocate General Josef Holzleithner appealed to the five-member senate of the Supreme Court (Chairman: Rudolf Lässig) to deny both appeals. The main defendant in particular showed “massive indifference to physical integrity, sexual integrity and the life of others per se,” said Holzleithner. He also referred to the 24-year-old’s three previous convictions. The defenders of the two native Afghans, Wolfgang Haas and Sebastian Lesigang, had asked the Supreme Court for milder sanctions.
