Austrian abused: verdict against ex-tennis pro confirmed

The Federal Supreme Court dismissed the man’s appeal against the judgment of the Valais judiciary. The conditional prison sentence of 20 months remains. An Austrian was the victim of the sexual assault.

The incident happened in 2014 in the Estonian capital Tallinn during a congress. The convict took part in it for the Swiss Tennis Association. After a boozy evening, he spent the night with the Austrian delegate. This emerges from a judgment of the Federal Supreme Court published on Thursday.

After initial memory gaps, the woman recalled non-consensual and violent sexual intercourse. She had numerous hematomas. In 2022, the ex-professional was convicted by the Valais cantonal court. He was acquitted on charges of rape.

The Federal Supreme Court explained the dismissal of the man’s complaint in detail. The assessment of the evidence and the reports by the Valais judiciary is not arbitrary. The injuries and bruises suffered by the victim could not be explained by falls during the evening. According to the court, the lower court was able to assume an “obvious traumatization” of the Austrian delegates after she gradually came up with scraps of memory. The trauma continued after her return home. This was followed by a loss of work and long-term psychotherapeutic care.
