56-year-old man sentenced to five years for attempted rape

The man is HIV positive. He also suffers from hepatitis – the latter he did not know until his arrest. The verdict is not final, the 56-year-old asked for time to think about it, the prosecutor gave no explanation. The accused happened to meet the woman on the street on April 28, 2023 and invited her to his apartment for coffee. There he is said to have attacked her and hit her in the face with his fists when she defended herself.

“A very religious man”

“What happened in the apartment?” the presiding judge asked the accused at the beginning of the hearing. “Nothing,” he replied, “I don’t understand why she (the alleged victim, note) is complaining about me.” However, in the course of his further questioning, he admitted that he grabbed her arms and threw her on the bed. But he had no “sexual intentions”: “She’s my cousin’s wife.”

“He’s a very religious person,” noted the defender. His client is married, for religious reasons sex with another woman is out of the question. The accused, who comes from Guinea, has been in Austria since 2016. His wife still lives in the West African country.

I took my pants off “because I was very nervous”

When asked why he had assaulted his acquaintance, the accused claimed that she had spoken badly about his cousin. He didn’t want to hear that anymore. He explained in court that he bit her lower lip, even though he suffers from communicable diseases: “We discussed it, and our mouths touched.” He forcibly pulled the woman’s pants off “because I was very nervous, I wanted to end the conversation.”

According to the woman – while the public was excluded from the trial during her questioning of witnesses – the defendant first let her go by begging him to let her go. As soon as she left the apartment, she went to the nearest police station and filed a complaint there.

“I was scared to death”

The police officers took photographs of the injuries inflicted on her. “I was scared to death. I thought I wouldn’t get out of here alive,” the woman said when she was questioned by the police.

Fortunately, she should not have been infected in the course of the violent activities that are the subject of the proceedings. For the time being, all test results have not provided any evidence of infection. However, the person concerned has to complete further check-up appointments by September to be sure that she is healthy.
