As of next Monday, August 1, retirees from all cajas will be able to maintain their passivity and continue working at the same time. This is “a very relevant change” that, according to the government, contemplates the situation of population aging and the extension of life expectancy in which more and more retired people are looking for a extra income to their passivities or continue with work activities in a registered manner.
The main condition is that those who want to continue working after accessing retirement must look for a new occupation during retirement; that is, they cannot continue in the same job that they had until the moment of retirement.
Likewise, those who are not retired and want to continue with their little business without employees, they may choose not to make further contributions as long as they meet the requirements to access the pension system. In case of having employees (non-dependent workers), they may also retire as long as they are 65 years old, 30 years of work and 3 years as non-dependent.
Who will be able to access this new regime?
All people who retire on or after August 1 they will be automatically included by this new provision in the pension system, as long as the law is already approved. However, the change is also retroactive, so that current retirees from the industrial, commercial, rural or domestic sectors will be able to return to work voluntarily and legally. It should be remembered that, currently, half of retirees —former public, bank, military or police employees— today have no restrictions on starting another work activity in the private sector.
As for the additional years of contributions, these will be computed once the person’s work activity has completely ceased. At that time, benefits will begin to be paid in accordance with the applicable regime, also including those extra years worked after retirement, so there should be a positive adjustment. In addition, you will have access to the contributions to AFAP and the solidarity supplement.
The six decrees ready to regulate the reform
For its part, the government already has the six decrees that will regulate this first stage of the social security reformaccording to the weekly Búsqueda.
Along with the provision that refers to the compatibility between work and retirement, those that refer to the survivor pensions Yet the solidarity supplement regulation.
Another decree includes the specific changes of the Social Welfare Bank (BPS) —modifications in the recognition and calculation of work, in the labor history and in the special regime of the staff of consulates, embassies and other international organizations—; while a fifth text regulates the commission that the reform created to collect the necessary evidence and carry out the studies and expertise to issue an opinion on subsidized services. This also includes the fictitious calculation for care and other transitory subsidies incorporated into the law.
Finally, the last decree refers to the changes to military and police retirement services.
