25-year-old convicted of raping a student

A 25-year-old was convicted of rape in the Graz Regional Criminal Court on Friday. He is said to have sexually assaulted a young woman in the toilet of a bar in western Styria in October 2022. While the accused denied the crime in court, the young woman gave credible information. The lay judges and judge Julia Riffel therefore had no doubt about his guilt. The man was sentenced to four years in prison. The judgment is not final.

T-shirt with the words “Fuck off”

The defendant had already attracted the attention of the associate judge at the beginning of the hearing with a T-shirt with the imprint “Fuck off”. “I didn’t have another fresh T-shirt,” said the 25-year-old. He denied raping the student. On the contrary: She kissed him in the restaurant, which witnesses also observed. However, the statements differed when it came to what had happened in the restaurant’s toilet.

The student was surprised by the man after going to the toilet, she said during the cross-examination, a video of which was shown at the trial. He pushed her back into the cabin, followed her and locked it. Neither her rejections nor repeated statements that she didn’t want that stopped him from continuing.

After a short consultation, the lay judges and the presiding judge agreed: the defendant was sentenced to four years in prison for rape and 5,000 euros in compensation for the young woman. “It is irrelevant who the kiss came from before and even if she said yes at the beginning: As soon as she says no once, it is no and everything else is rape,” explained the judge. The accused was surprised and asked for three days to think about it. The prosecutor’s office made no statement. The judgment is not final.
