Prosecutors will present the unconstitutionality against the questioned article of the Accountability

The Association of Fiscal Magistrates of Uruguay (AMFU) will present an appeal of unconstitutionality against the article of the law of Accountability that yesterday he finished approving the Chamber of Deputies and that establishes a three-year inhibition for the exercise of activity in the private sector after leaving office as prosecutor.

Article 630 of the Accountability continues to generate conflict with the country’s prosecutors, who denounce “harassment” by a political sector. After the approval of the bill, the Association of Prosecutors will seek to advance the suppression of said article by the only way it has left, while maintaining forceful measures: presenting the action of unconstitutionality before the Supreme Court of Justice (SCJ).

“Once the law is enacted, there is still the veto of the president of the Republic but it is not very feasible,” explained the president of AMFU, Willian Rosa, in dialogue with Radio Universal, in relation to the decision to advance through judicial means.

“There is cruelty against the prosecutors, no one can ignore it,” Rosa emphasized and regretted that the higher budget request has been ignored by five consecutive surrenders and yet this article has been debated “in five days.” “Came in through the window in a hurry,” he added.

“The most paradoxical fact is that in 2022 they gave an increase to judges and that increase should also have been foreseen for prosecutors. They recognized it in Parliament, but the Surrender ended and that has not been amended. How can we accept that something that is recognized as error is not solved?”, considered Rosa, regarding the other points of the platform of claims that the prosecutors have been promoting for a week in line with the claim for the Accountability article and the forceful measures carried out.

What are the prosecutors demanding?

From the mobilization that the AMFU carried out yesterday at Parliament, While the deputies finished voting on the Accountability, Rosa shared point by point the demands promoted by the organization.

In that sense, he pointed out that it is necessary “not to leave Prosecutor’s office weakened and without resources —at least— until 2026; that they correct the errors that they admitted to making, by giving an increase to Judges and not to Prosecutors (knowing that they are equal); to solve the salary inequality suffered by more than 220 Attached Prosecutors in the country, who do the same as the Deputy Prosecutors but earn 20% less salary; to remove from the project unconstitutional inhibition of the Prosecutors after the Termination, approved in a week in the Senate; and fundamentally, ask that the harassment that certain actors of the political system permanently carry out towards the Prosecutor’s Office and towards the Prosecutors. Well, lastly, if you’re not going to give us anything we deserve, at least let us work in peace.”

Although many of the claims have been raised for years, the factor that unleashed the conflict at higher levels was the inclusion of article 630 in the Accountability, as well as the refusal to withdraw it from the articles.
