The child’s best interests were not examined in the case, which was unconstitutional, criticized Griss.

According to criticism, the 16-year-old and his siblings were not questioned by the authorities and their children’s rights were therefore ignored. The case is reminiscent of that of 12-year-old Tina, who was deported to Georgia in 2021, as a result of which the Child Welfare Commission was set up, said Griss. Katharina Glawischnig from the Asylum Coordination argued that 16-year-old Jaba’s family was also well integrated. A sister is about to graduate, the father has a permanent employment contract, and the mother has a job offer.

The Georgian family came to Austria five years ago and received subsidiary protection because their son was being treated for leukemia in Austria. After the boy was healed, his application for humanitarian leave to remain was rejected.
