The lawyer of Pauline DaviesJorge Barrera, presented at the Alejandro Machado’s Prosecutor’s Office the request to archive the case of the delivery of the passport to the drug trafficker Sebastian Marset after a year and a half, arguing that no criminal violation was found.
Davies was director of Consular Affairs of the Chancellery when the passport was handed over to marset while detained in the United Arab Emirates (EA) for carrying false documentation of Paraguayan nationality.
According to El País, the file request on the part of the hierarchy corresponds to the fact that in the course of a year and a half of investigation – time that they consider more than enough – no no criminal violation in the procedure carried out. In addition, Barrera specified that the delivery of the document was following current law and without any legal impediment.
On the other hand, Barrera’s letter specifies that, so far, the investigation has not reached any conclusion regarding who is responsible for delivering this type of documentation when the person is outside the country: the Ministry of Interior either Chancellery.
Finally, the defense lawyer of the leader assured that she acted in accordance with the current legislation and assured that he did not have the right to arbitrarily intervene in a procedure that complied with the corresponding legal requirements.
For the Prosecutor’s Office, the person responsible is the Chancellery
For prosecutor Machado there is only one person responsible: Chancellery. According to the prosecutor, the culprit is the office that issues the passport and that is a function of the Ministry of External relationships. Machado is based on the third article of decree 129/2014 of the Regulation regarding the issuance of common passports, identity and travel titles.
There, it is established that, if the passport is requested from inside the country, the responsibility for issuing the document corresponds to the Ministry of the Interior, through the National Directorate of Civil Identification. However, if it is requested abroad, the issuance of the Ministry of Foreign Affairs through Consular Officials.
However, in 2018 a modification was decreed establishing that passports requested abroad are the responsibility of both ministries. Meanwhile, the provision of this decree was after the issuance of the passport of Marset.
