This is not discrimination as long as such bans on religious signs are applied generally and indiscriminately to all administrative staff and are limited to what is absolutely necessary, the judges of Europe’s highest court said on Tuesday in Luxembourg.

The background is a case from Belgium. The office manager of a municipality was not allowed to wear the Islamic headscarf at work. The community stipulated strict neutrality in its work regulations: all employees were therefore prohibited from wearing conspicuous signs of ideological or religious affiliation.

Upper Austria’s FP boss and LH deputy Manfred Haimbuchner welcomed the verdict and announced that such a ban would also be legally examined for the state service in Upper Austria. If one follows the saying from Luxembourg, the visible wearing of a cross or a kippah would also have to be prohibited.
