The Prosecutor’s Office re-filed the file with the complaint of the Broad Front (FA) for the expansion of the concession of the Container Terminal of the Port of Montevideo to the Belgian multinational Katoen Natie until the year 2081.

The Prosecutor for Economic and Complex Crimes, Silvia Porteirostated in his opinion that he reached the decision to archive the file after a “considered analysis.”

“After a thoughtful analysis of all the evidence integrated into the investigation, the proceedings are filed,” he stated in the opinion. Porteirosince “since the conclusions widely expressed by the pre-opinion prosecutor are substantially shared, to which nothing can be added, under penalty of falling into useless reiterations.”

Likewise, he added in the prosecutor’s opinion that “it was clearly and forcefully resolved that, without prejudice to some irregular or reprehensible actions, these are not sufficient to classify the injustice that is intended to be imposed.”

After the FA presented an extension of the complaint, on May 18, 2023, the case had been unfiled for investigation, and was refiled on November 14. The complaint for alleged irregularities had been promoted by the Broad Front senators Charles Carrera, Enrique Rubio and Mario Bergara.

According to the opinion, “it is concluded that the factual platform is criminally atypical and even the aggregation of the new evidence did not result in a decisive contribution to the case, so given the principle of objectivity that guides the actions of the Public Ministry, it has the duty to file when it is noted that the conduct of the accused has no criminal relevance”.
