Sex for drugs: Ten years in prison for 66-year-old in Vienna

The man accepted the punishment meted out to him. The judgment is already legally binding.

“I don’t normally ask women to do anything,” said the man on Wednesday at the Vienna regional court. However, he did not act as a kind of good Samaritan towards drug addicts and gave them the substances free of charge. Rather, he repaid the drugs with sexual acts.

“It was an open secret in the drug scene that the defendant got drugs for sex,” said the prosecutor. A number of women “willingly took up this offer under the motto ‘It’s great that you don’t have to pay anything for cocaine’,” the prosecutor continued. As far as sexual criminal law is concerned, this is not a criminal offense: “In three cases, however, he took advantage of the drug addiction of the women concerned. Some of the three were homeless, they were in a predicament. They saw no other option than this deal enter into.”

Women were “fit”

According to the prosecution, the 66-year-old violated the sexual self-determination of the three much younger women within the meaning of Section 205a of the Criminal Code. In addition, the hearing for two of the three affected also involved sexual abuse of a defenseless person (§ 205 StGB). The defendant let the two of them stay overnight in his apartment. When they were in a corresponding state, sometimes on the verge of unconsciousness, as a result of the drugs they had consumed, the 66-year-old had sexual intercourse with them. He filmed with his cell phone and saved the material, which was seized during the evaluation of his cell phone data and included in the court file.

The 66-year-old, who has accumulated a total of 25 previous convictions at home and abroad since the 1970s, confessed to the accusation of using sex as a means of payment. “I didn’t really think about it. To a certain extent I took advantage of the opportunity,” said the Carinthian native. He denied having abused defenseless women: “When you take cocaine, you don’t tip from left to right.” The women were “fit,” he claimed. When the presiding judge asked why he had taken images, the defendant did not give a concrete answer.

According to the prosecution, the man had sold more than a kilogram of cocaine and at least 800 Substitol tablets. He bought the drug substitute himself from a pharmacy in order to get his own addiction under control. When he was clean, he continued to go to the pharmacy and trade the pills “because the rent is 750 euros a month,” as he said on record. He then demanded 100 euros per gram for the cocaine, which he had bought for 70 euros per gram. According to a report, the drug that was seized from the man during the arrest had a purity content of 79.6 percent.
