The 50-year-old home worker is accused of having incorrectly dosed a drug (methotrexate) for several days. Instead of a weekly dose, the drug was administered daily for around a week. The 84-year-old is said to have died from it. According to a spokeswoman for the Linz Public Prosecutor’s Office, who confirmed the case on request, charges of grossly negligent homicide have been brought after the pensioner suffocated in February.
The accused was an employee who was responsible for planning the dispensing of medication, but not for administering it. A corresponding criminal complaint had been submitted. After an initial examination, the regional court decided that there was no suspicion of gross negligence. Accordingly, the district court would be responsible. The prosecution continues to assume gross negligence and thus the jurisdiction of the regional court. Now the higher regional court has to decide on the question of jurisdiction, it said on Friday.
