UN ICJ demanded from Azerbaijan to prevent incitement of racial hatred

The UN International Court of Justice (ICJ) in The Hague ruled that Azerbaijan take the necessary measures to prevent incitement to racial hatred against Armenians. This was announced on Tuesday, December 7, by the chairman of the court, Joan Donoghue, when deciding on the claim of Armenia.

“Azerbaijan, in accordance with its obligations under the international convention on the elimination of all forms of racial discrimination, must protect prisoners from violence and harm. and must take all necessary measures to prevent incitement to racial hatred and discrimination, including by officials, against ethnic Armenians, ”she said.

On November 26, Sochi hosted a meeting between Azerbaijani President Ilham Aliyev, Armenian Prime Minister Nikol Pashinyan and Russian leader Vladimir Putin. It lasted about three hours and was timed to coincide with the anniversary of the signing of the ceasefire statement in Nagorno-Karabakh on November 9, 2020.

During the trilateral talks, the heads of state discussed the situation in the Karabakh conflict zone and the ways of its settlement, as well as assessed what was done over the past year to stabilize it.

Following the meeting, a joint statement was issued. It indicates that the parties agreed to take steps to increase the level of stability and security on the Azerbaijani-Armenian border. In addition, an agreement was reached on the creation of a bilateral commission on the delimitation of the state border with its subsequent demarcation with the advisory assistance of the Russian Federation.

On September 16, Armenia initiated legal proceedings with Azerbaijan in the International Court of Justice of the United Nations in accordance with the International Convention on the Elimination of All Forms of Racial Discrimination. The lawsuit notes that “Azerbaijan has subjected Armenia to racial discrimination for decades,” which was expressed, among other things, in massacres, torture and other violations.

Armenia and Azerbaijan have disputed the ownership of Nagorno-Karabakh since 1988. Then the region, in which mainly Armenians live, announced its secession from the Azerbaijan SSR. During the 1992-1994 military conflict, Baku lost control over Karabakh. In September 2020, during the hostilities, Baku took control of a number of settlements in the region.

In November 2020, Armenia and Azerbaijan, with the participation of Russia, signed an agreement on the cessation of hostilities in Nagorno-Karabakh. The document also provides for the introduction of Russian peacekeepers, the exchange of prisoners between the parties to the conflict, the transfer of a number of regions of the region by Armenia to Azerbaijan and the return of refugees to Karabakh.
