With this decision, is the Upper Austria Football Association opening the door to an arms race in the amateur sector in the winter transition period? Like the Lower Austrian football association, the one in Upper Austria is now suspending the association player regulation from the spring season.
This decision was preceded by a resolution of the ÖFB’s appeals senate, which followed a complaint from the SKN St. Pölten and overturned a resolution of the NÖFV protest committee of August 1, 2023 without replacement. In its justification, the ÖFB pointed out, among other things, that such provisions do not fundamentally violate EU law as long as they are based on sporting reasons and are proportional. And the ÖFB sees this as not being the case with a “…disproportion of 2 to 15 in favor of the self-made players…”.
Previously, a maximum of two non-association players were allowed to appear on the match sheet. Association players are those kickers who have been registered with ÖFB clubs for at least four years or who have had their registered main residence in Austria for at least two years. Young players also counted as association players from the time they first registered in Austria.
Since the association player regulation in Upper Austria was applied in the same way as in the neighboring federal state with regard to the permitted upper limit of two non-association players, the Upper Austrian association also reacted to the decision of the ÖFB Appeals Senate. Previously, violations were punished with a 0-3 penalty for the respective game.
This is how it continues
The Match Operations Commission has now been tasked with rethinking the association player regulations and developing possible alternative solutions for the future. Especially since the Upper Austrian Football Association remains convinced of the usefulness of the regulation despite the decision of the ÖFB Appeals Senate, as it says in a press release: “However, maintaining the provision would not have been effective, as any sanction that would be imposed against a violation would have been imposed , would have been overturned by the ÖFB appeals senate at the latest. Nevertheless, we appeal to all clubs not to completely throw their previous attitude overboard and to continue to rely on their own talents instead of recruiting players from outside.”
This is now possible because: Clubs are now entitled to use more than two non-association players. This also makes it possible for the clubs to increasingly rely on legionnaires from neighboring countries. After all: The self-made player regulation remains in place, so that at least six players with self-made player status per club (note: kickers who have played for the club for at least three years) must be nominated on the match report.
