He was sentenced to three years at the Regional Criminal Court on Tuesday (December 7) for pushing a prison guard down the stairs and giving heel money at a court hearing at the Palace of Justice. However, he did not get far. Colleagues of the officer caught up with the fugitive and were able to overpower him at Schmerlingplatz. The five previous convictions for drug and property offenses had been brought by the judicial guard to his appeal hearing in the Higher Regional Court (OLG) on March 12, 2021. Most recently, he had cashed in for 24 months for burglary. The OLG dismissed the man’s criminal appeal.
The prospect of having to stay in jail should have let him through the fuses. When leaving the courthouse, which is home to the highest judicial authorities in the country, in addition to the OLG, he gave a security guard a strong push in the back on the outside staircase. The officer fell down the steps and remained at the bottom of the stairs. Meanwhile, the 29-year-old tried – as it turned out in vain – to escape the officers’ colleagues.
For the current trial for resistance to state violence and serious bodily harm – the officer had sustained serious injuries, including a bruised skull that made him incapacitated for a longer period – the 29-year-old was escorted by a large contingent of the judiciary to be on the safe side. The defendant tried to play down his behavior in front of Judge Stefan Renner, but did not meet with understanding. When determining the sentence, in addition to the troubled past life, above all the rapid relapse was taken into account as an aggravating factor.
The judgment is not final. The sentence was too high for the 29-year-old, after consulting his procedural assistant, he filed a full appeal. Thereupon the public prosecutor also appealed to punishment.
