New guidelines for family judges on dealing with violence

In order to protect children from physical and psychological violence, Justice Minister Alma Zadic (Greens) had experts from child and women’s protection prepare a new guide for family judges on Friday. The aim is to identify domestic violence more quickly and take action against it.

The guidelines were developed for two years in order to create a standardized approach to violence against children and their important caregivers. Voluntary training for family judges will begin in February.

It is always necessary to actively ask victims of domestic violence if they have been insulted or humiliated. “The people affected by violence mistakenly consider these behaviors to be legally irrelevant,” said family judge Christine Miklau.

The child’s well-being is the top priority in the new guidelines, and not that both parents have custody and that there will continue to be contact with both in the event of a divorce, says Alma Zadic.

Support for children

Above all, child support – a psychosocially trained companion with experience in working with children – should be given a higher priority in the custody process thanks to the new guidelines: This is “an important instrument and gentle and age-appropriate support,” says Hedwig Wölfl, managing director of the child protection organization “Gull”. In 2023 alone, 240 child advocates were already working for the judiciary.
