Yesterday the state parliament spent three quarters of an hour dealing with the controversial camping project in the Stodertal. As reported, the Constitutional Court (VfGH) had annulled parts of the local development concept and the zoning plan as well as the development plan in the area of the former Villa Peham as illegal. The Greens now wanted to know from State Councilor Markus Achleitner (VP) why the lack of basic research and balancing of interests was not criticized in the regulatory approval under his responsibility.

The highest court applied a stricter legal opinion regarding “basic research and balancing of interests” on the part of the municipality than the state’s spatial planning department, said Achleitner in his answer to the urgent question: “Of course, the spatial planning department will apply this opinion of the Constitutional Court in the future. Statements that would be dedication decisions without sufficient basic research and balancing of interests, but do not apply.” The local council submitted the documents later. “All five specialist departments have given a positive opinion on the rezoning” of grassland in SOTB (note: special area of building land – tourism operations). Villa Peham has always been dedicated to tourism.

However, the Constitutional Court ruling has no direct impact on the shell, as it was built on the basis of a building permit that was granted. However, a complaint against the building permit is still pending at the State Administrative Court. “In terms of creating a situation that complies with the dedication, the ball is now in the community’s court.” In any case, he thinks the project is excellent.
Rudi Hemetsberger, member of the state parliament for the Green Party, sees it differently: The municipality could not have been objective about the dedication because, as the seller of the property, it was interested in the rededication. In the local development concept, she stipulated that the area to the left of the Steyr should be kept free of new development. “Not only the Constitutional Court, but also 15,000 people who signed against it, saw it that way. But they were laughed at and talked down to.”
