Truck driver in Tyrol found guilty of murder

The jury’s verdict was unanimous. The man was accused of killing a 35-year-old countryman with twelve stab wounds after an argument in a motorway parking lot in Inzing (Innsbruck-Land district) in May 2023.

The defendant, who had around two per mille of alcohol in his blood at the time of the crime, argued at the hearing before judge Helga Moser, contrary to his previous statements, that he could “remember very little”. But it could “still be good” that he stabbed and injured his work colleague with a knife, he said.

Showdown with beer and vodka

The Polish truck driver told the jury that his confession to the police was “largely a made-up story.” Which the executive “forced” him to do during the interrogation. The Pole also claimed that there was another “unknown man” next to him who had also injured his colleague.

For public prosecutor Andrea Walder, however, the case was clear. “The two work colleagues agreed to meet at the rest stop at the end of the day and wanted to eat and drink together,” she said. Later, under the influence of beer and vodka, there was a “show of strength” – which then led to a serious argument. The defendant finally gave his victim a “first stab” in the car and – when he fled – the further eleven stabs outdoors between two vehicles.

“No murder intent”

The defendant’s defense attorney, Roland Seeger, did not deny the stabbings. “My client, however, only speaks of three stitches.” However, there was never any “intent to murder”; manslaughter had to be assumed due to the massive alcohol consumption.

Judge Helga Moser did not mention any mitigating circumstances in her verdict. She also did not accept the fact that she was under the influence of alcohol, as the 36-year-old already knew from the past that he reacted aggressively under the influence of alcohol. After a short conversation with the defendant, the defense attorney announced an appeal for nullity.
