The reasons for detention were the risk of collusion and the risk of committing a crime, court spokeswoman Christina Salzborn said on Sunday afternoon. The Vienna public prosecutor’s office is investigating the parents of the little boy, who presumably died as a result of shaken baby trauma, on suspicion of murder.

As Salzborn explained, both the 29-year-old man and the woman, who was three years younger than him, did not provide any information to the judge about the accusation against them of inflicting fatal injuries on their son. The pretrial detention order, against which the mother’s legal representative did not lodge a complaint – the father was not represented by a lawyer – is initially legally effective until February 26th.
Arrested on Thursday
The parents were arrested last Thursday and taken to the Josefstadt prison (JA) on Friday. The public prosecutor’s request to impose pre-trial detention was decided on Sunday. The baby’s mother took the infant to a hospital at 11 p.m. on February 3, where treatment for the allegedly abused infant began immediately. But medical help came too late for the little boy. He probably no longer had any brain functions at the time he was admitted to hospital. On Tuesday, the life support machines were switched off and the boy was pronounced dead.
Autopsy ordered
The hospital subsequently alerted the police because the baby had brain injuries that typically indicate so-called shaken baby trauma. As part of the ongoing investigation, the public prosecutor ordered an autopsy of the body to clarify the exact cause of death. Of course, the written report is not yet available, but according to reports, in addition to the head injuries, the baby also had a broken rib and a broken arm.
From an open and criminal perspective, the crucial question is who and under what circumstances inflicted the ultimately fatal injuries on the small child. The mother has so far exercised her right to refuse to testify; the father is said to have told the police that he could not explain his son’s injuries.
