On Tuesday, a man was sentenced to twelve years in prison at the Vienna Regional Criminal Court for rape, serious sexual abuse of minors and serious bodily harm. The defendant took three days to think about it, so the verdict is not final.

According to the prosecution, the students – the youngest was ten years old when the crimes began – have regularly visited their uncle by marriage, who lives outside of Vienna, since 2014. The girls, who came from difficult backgrounds, also spent weekends and holidays with him, often for several days. Since 2017, the man is said to have taken advantage of opportunities to sexually assault when his wife was not at home. As at the start of his trial in mid-November, the defendant denied all allegations.

Wife testified for her husband

When questioned on Tuesday, the man’s wife also denied witnessing any attacks. On the contrary: the initiative to spend time with them always came from the girls, and one of the children even wanted to be adopted by the couple. In addition, her husband had no opportunity to engage in sexual activity because he was never home alone with any of the girls. “Either I was there or other children were there,” the woman testified.

In addition to the statements of the three girls, the man was also incriminated by a chat with a clearly sexual connotation, in which the man also admitted to such actions. In addition, the new medical and psychiatric reports obtained since the first day of the trial made the allegations more difficult. Both girls who the man is said to have raped were diagnosed with post-traumatic stress disorder, which could not be explained without the attacks, which is why public prosecutor Julia Kalmar expanded the charge to include the offense of serious bodily harm. In addition, a girl was found to have a non-naturally formed notch in her genital area, for which there was no corresponding history.

Defense demanded acquittal

Despite the evidence, the defense demanded an acquittal due to contradictory statements from the girls. However, the jury did not accept this request and sentenced the man to twelve years in prison. With a punishment range of five to fifteen years, the amount of the sentence seemed appropriate to the court, as only the man’s previous blameless lifestyle could actually be used as a reason for mitigation. The man also has to pay the girls a total of around 90,000 euros in reparation.

The accused asked for three days to think about it, but the public prosecutor’s office made no explanation. The judgment is therefore not legally binding.
