It’s about the rejection of the suspensive effect by the Upper Austria. State government, which was applied for by environmental organizations at the end of 2023.
According to a current release, the two organizations want to use the new complaint to prevent damage caused by the search for fossil gas in the Jaidhaustal nature reserve near the Kalkalpen National Park. “The suspensive effect of complaints is an important component of effective legal protection,” says Franz Maier, President of the environmental umbrella organization. This is particularly important in nature conservation “because otherwise, as in Molln, the environment will be seriously affected despite the lack of a legally binding decision and ongoing complaint proceedings.”
According to Nature Conservation Association President Thomas Wrbka, the Upper Austrian legal situation with a blanket exclusion of the suspensive effect for complaints violates the Aarhus Convention. “We will continue to resist the creation of a fossil-fuel industrial landscape at the gates of the Kalkalpen National Park.”
